- Full Utah Gun Exchange Terms of Use and User Agreement.
- By accessing or using UtahGunExchange.com, including any subdomains or affiliated websites that form part of the broader UtahGunExchange.com network (collectively, the “Site”), you expressly agree to be bound by the terms and conditions set forth by Utah Gun Exchange, LLC and its affiliated entities (referred to as “UtahGunExchange.com,” “we,” “us,” “our” or “the Company”). Your ability to register for or participate in any activity on the Site is conditioned upon your review and acceptance of this UtahGunExchange.com Terms of Use and User Agreement (the “Agreement” or “Terms of Use”). Your acceptance of this Agreement constitutes a binding commitment to follow all applicable provisions herein, as well as those referenced in linked policies such as our Privacy Policy and Site Rules. Please note that specific pages or sub-sites operated under the UtahGunExchange.com umbrella may include additional terms unique to those areas, which will be presented to you at the time of access.
- Throughout this Agreement, the terms “you” and “User” refer collectively to: (a) any individual who creates or maintains an account on the Site or who otherwise consents to this Agreement, and (b) if identified during registration, any associated business or governmental entity you represent (“your Company”). Both you and your Company, where applicable, are jointly accountable for compliance with this Agreement.
- By using this site, you are expressing consent to these Terms of Use. You are not authorized to use this Site or the content found on it, if you do not agree to these Terms of Use.
- Registration and Posting
- Eligibility and Accuracy of Information. By registering for an account or using the Site, you affirm that you are of legal age in your state or country of residence and that you agree it is your responsibility to know and abide by all applicable laws. In cases where you have registered an account on behalf of your Company, you represent that you are duly authorized under applicable law to enter into legally binding agreements on its behalf whenever you interact with the Site. Additionally, you agree that your account is for your exclusive use: you will not allow others to access or use it, nor will you use it to act on behalf of another person or entity.
- Site Rules. Your continued use of the Site is also subject to your adherence to specific operational standards governing transactions, account security, user behavior, and other Site-related practices. These standards are set forth in the “Site Rules”, which are primarily accessible through designated pages on the Site but may also appear elsewhere within the platform. The Site Rules are incorporated into this Agreement by reference and carry the same legal force as if reproduced in full within these Terms of Use.
- Termination and Suspension. Subject to the terms of this Agreement and the Site Rules, we agree to provide you with access to the Site and its services. However, we retain full discretion to decline your registration request or to deactivate your account without obligation to provide a reason. Even after your account has been accepted, we reserve the right to suspend, limit, or revoke your access to the Site or any portion of its services at any time, with or without prior notice or stated cause. If we determine that your conduct may expose us or other users to potential liability or harm, we may also choose to notify other users of such conduct.
- User Options; Account Closure. If you do not agree to the terms of this Agreement, as amended from time to time, you are not permitted to access or use the Site or any of its content. Should you become dissatisfied with the Site or its services for any reason, you may pursue the following options: (1) submit feedback or requests for improvement; (2) temporarily cease using the Site and its services; (3) cancel your membership; (4) initiate closure of your account; and (5) notify us of your cancellation or closure, if desired. You are free to close your account at any time; however, you remain responsible for any outstanding obligations as of the closure date. Communications related to your account status should follow the process outlined in the Notices section of this Agreement. Please note: an account that remains inactive for one year may be considered closed and marked as such in our records. Nevertheless, we may retain certain user and transaction data as part of our permanent records.
- Amendments; Updates. We retain the right, at our sole discretion, to modify this Agreement (including the Site Rules, Privacy Policy, and any associated documents) at any time, effective upon posting, with or without notice. Your continued usage of the Site after such changes indicates your acceptance of the revised Agreement or additional terms.
- User Postings. We provide sellers with tools and guidelines for listing items for sale on the Site (each such item, a “Listing”). Buyers, sellers, or registered users may communicate with other users or post text, graphics, pictures, and other content on the Site (collectively referred to as “Postings”). We retain the right to monitor, edit, approve, or remove any Posting or Listing from the Site at our discretion. Our oversight of Listings and Postings is discretionary and should not be interpreted as an endorsement, verification, or guarantee of accuracy. Users should not rely on the presence of content on the Site as assurance of its truthfulness or compliance with applicable laws.
- Accuracy. You represent and warrant that all information provided to us (including your name, address, and any other account-related information known as personally identifiable information (your “PII”), and all communication with other users of the Site, whether in a Listing or a Posting, is truthful, accurate, current, and not misleading.
- Privacy. We will not send you marketing communications unless you have expressly consented to receive them. Likewise, we do not sell or lease your personal data to third parties without your explicit permission. All handling of your personal information is governed by the Utah Gun Exchange Privacy Policy, which is incorporated by reference into this Agreement. Your data is stored on secure servers located in the United States. You retain the ability to view and update the information you have provided to us, as well as to modify your communication preferences to opt out of certain types of contact. For a comprehensive explanation of how your information may be used and the choices available to you, please refer to the Utah Gun Exchange Privacy Policy. By agreeing to these Terms of Use, you are also agreeing to the terms of the Privacy Policy. If you do not agree with how your PII may be used as outlined in that document, you should not register for or use our services.
- Third Party Websites. The Site may contain links to third-party websites and advertisements. UtahGunExchange.com is not responsible for and does not have any liability for the privacy practices or other actions of these third parties. We encourage you to review the privacy policies of any websites you visit.
- Transactions on the Site
- Fees. You agree to pay the applicable fees for using the Site, understanding that ALL FEES PAID TO US ARE NON-REFUNDABLE.
- Credit Cards and ACH Direct Payments. By entering a credit card or ACH direct payment account with us, you authorize us to charge your card for any fees incurred from using the Site. You may revoke this authorization by providing a written request to Utah Gun Exchange, LLC, PO Box 1392, Sandy, Utah, 84091. We may continue billing your credit card or direct payment account for any fees incurred prior to receiving your written revocation. Charges may appear under “Utah Gun Exchange, LLC” or “UtahGunExchange.com.” Users may be required to verify and maintain accounts with a credit or debit card before placing ads or contacting sellers. Due to our security protocols we cannot accept prepaid gift cards. Please use a credit card or debit card in your name. The Security Verification Transaction payment, if applicable, is to cover security review only, no other service is provided with the fee. However, you may receive a discount from participating UGE sponsors by using your sign up code receipt. Credit may be less than, equivalent to, or greater than the full amount of your Security Verification Transaction payment. Purchase must be of equal or greater value. Additional details apply. BY USING A CREDIT CARD, YOU UNCONDITIONALLY WAIVE ANY AND ALL CHARGEBACK RIGHTS YOU MAY HAVE. If you have questions about a charge on your credit card, please contact us as detailed in the Notices section below. If you issue a chargeback on your credit card, whether intentionally or inadvertently, your account may be terminated, and you agree to pay a $50 processing and collection fee.
- Past Due Accounts. Should a seller’s account become past due, we reserve the right to void, suspend, or terminate their ********** listings and may terminate their account.
- Only a Venue. You understand and acknowledge that we are not auctioneers or a dealer performing a transfer. The Site serves solely as an advertising venue for the sale of firearms, accessories, and related items (“Items”) through a ********** listing format. We are not directly involved in transactions between buyers and sellers, and we do not guarantee or represent that:
- Users of the Site are not misrepresenting their identity, location, or authority to enter into contracts.
- A seller listing an Item is able to complete the sale or deliver the Item, nor that a buyer is able to complete the purchase.
- Sellers have accurately described their Items listed on the Site.
- Listed Items exist, are safe, of particular quality, non-infringing, or free of liens or encumbrances.
- The sale and transfer of an Item comply with applicable laws and regulations.
- Sellers and Buyers
- Seller Obligations. Listing an Item indicates intent to sell or trade that Item if your terms are agreed to. You agree to fulfill the sale for all listed Items accordingly. You confirm to us that you possess the legal right to sell the Items you list, and that listing your Items will not (1) involve fraudulent activities, counterfeit, or stolen goods, (2) infringe on any copyrights, patents, trademarks, trade secrets, or other proprietary rights, or (3) violate any applicable laws.
- Legality of Purchase and Shipment. If you are involved in the sale, purchase, transfer, or shipping of Items, you shall comply with all relevant legal requirements for their transfer and shipping, including but not limited to those detailed in the Site Rules. You:
- shall follow all legal guidelines in listing, selling, transferring, and shipping Items;
- shall be responsible for adhering to all applicable export and import regulations for these transactions;
- shall pay any required taxes or duties;
- may not engage in unethically manipulating sale prices; and
- shall comply with the following sale terms on the Site:
- In the U.S., when dealing in interstate transactions or with a Federal Firearms License (FFL) holder, firearms must be transferred through a Federal Firearms License (FFL) holder.
- Items may not be sold or shipped in violation of any federal, state or local laws, which may differ greatly.
- Certain Items like ammunition or knives might require proof of age to ship in or to certain states, and in some places, these Items may not be sold at all.
- U.S. Requirements. If you or the Items you are negotiating for are located or owned within the U.S., you warrant that you understand U.S. laws regarding export restrictions and sanctions, and you agree that: (1) you are not located in any country that is under U.S. embargo, and (2) you are not listed on any restricted parties lists maintained by the U.S. federal government.
- Taxation. You acknowledge that Utah Gun Exchange, LLC is not responsible for reporting, collecting, or remitting any taxes related to sales or transactions made through or related to the Site. You agree to be responsible for any sales/use tax or similar fees and indemnify us against any liabilities associated with tax issues arising from your transactions.
- Release. You recognize that we do not assume ownership or possession of any Items listed on the Site and do not represent either party in any transaction. In disputes with other users (buyers or sellers), you release us and our affiliates from any claims, demands, or damages of any kind resulting from such disputes.
- Transfer of Title. We do not transfer legal ownership of Items from sellers to buyers. Under certain Uniform Commercial Codes, ownership of an item is transferred upon the physical delivery from seller to buyer. Unless otherwise agreed by both parties, ownership of the Item transfers to the buyer on their receipt of the item.
- Intellectual Property
- Use of Content. All content made available on the Site, including but not limited to images, text, designs, graphics, videos, software, and data compilations (collectively, the “Content”), is the exclusive property of the Company and the Site or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Content solely for your personal, non-commercial use in direct connection with the services offered on the Site. No ownership rights or licenses are transferred to you by virtue of your access or use. You may not download, copy, reproduce, modify, distribute, display, perform, publish, transmit, or otherwise exploit the Content in any form or by any means without our express prior written consent. This prohibition includes the creation of derivative works, commercial redistribution, scraping, or use of automated tools to extract Content. All software and underlying code used in connection with the Site is owned by the Company and/or the Site or its authorized partners and is similarly protected. Unauthorized use of any Content may result in civil or criminal liability, and we reserve the right to take any legal action deemed necessary to enforce our rights.
- Copyrights and Trademarks. Unless stated otherwise, all Content is protected by copyright and other intellectual property laws. The compilation of all Content on the Site is the exclusive property of the Company. “UtahGunExchange.com®”, the logo, and other related marks are trademarks or service marks of Utah Gun Exchange, LLC. Other trademarks are the property of their respective owners. You may not use any trademarks or service marks without the owner’s express written permission.
- Site Abuse. You are prohibited from attempting to violate the Site’s security and from abusing the Site, including accessing unauthorized data, tampering with systems, sending unsolicited communications, or collecting information about other users without the expressed written consent of the Company.
- User Submissions. Any reviews, comments, or suggestions submitted to the Site or Utah Gun Exchange become the property of Utah Gun Exchange. This includes rights over any copyrights or intellectual property in these submissions. We may use these submissions freely without limitation.
- Our Limits of Liability
- Disclaimer of Warranties. You agree that your use of the Site and its services is at your own risk. The Site and its services are provided “as-is” without any warranties, either express or implied. We do not guarantee that the Site will operate without interruptions or errors, nor do we endorse any items posted on the Site or transactions made through it.
- Limitation of Liability. To the fullest extent permitted by applicable law, under no circumstances may the Company its affiliates, or their respective owners, officers, employees, or agents be liable for any consequential, incidental, indirect, special, exemplary, or punitive damages (including but not limited to lost profits, loss of data, loss of goodwill, business interruption, or cost of substitute services), regardless of the cause of action, arising out of or related to these Terms of Use, the Site, any products or services offered through the Site, or the inability to use the Site, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, the total aggregate liability of the Company and its affiliates for any and all claims arising out of or relating to these terms of use, your use of the site, or any product or service offered through the Site, regardless of the form of action (including, without limitation, contract, tort, negligence, strict liability, or otherwise), may not exceed the total amount paid by you to the Company for the specific product or service that gave rise to the claim, if any. The foregoing exclusions and limitations shall apply regardless of whether any remedy fails of its essential purpose.
- Indemnification. You agree to indemnify and hold harmless Utah Gun Exchange, LLC, its affiliates, and related parties from any claims or expenses arising from your actions on the Site, including breaches of this Agreement.
- Governing Law and Dispute Resolution
- International Users; Choice of Law. The Site is controlled by Utah Gun Exchange, LLC, based in the United States. Your use of the Site must comply with all local laws, particularly if you are located outside the U.S. This Agreement and its interpretations will follow the laws of Utah.
- Notices. Any notices sent to us should be directed to our electronic support system via e-mail at [email protected] or via USPS to Utah Gun Exchange, LLC, PO Box 1392, Sandy, UT 84091. Notices sent electronically are considered received upon receipt of delivery confirmation; mailed notices are typically received three business days after mailing.
- Electronic Execution. Your electronic acceptance of this Agreement has the same legal effect as a physical signature.
- Independent Contractors. You are an independent contractor, and no agency relationship is established between you and Utah Gun Exchange, LLC.
- General Provisions. If any part of this Agreement is invalidated by a court, the remaining provisions will remain in effect. No waiver of rights under this Agreement will be considered a waiver of any other rights. This Agreement represents the entire agreement between you and Utah Gun Exchange, LLC, superseding all prior agreements.
- Dispute Resolution.
- BY ENTERING INTO THIS AGREEMENT, YOU EXPRESSLY WAIVE THE RIGHT TO BRING OR PARTICIPATE IN ANY ACTION IN COURT OR BEFORE A JURY, INCLUDING THE RIGHT TO PURSUE OR JOIN IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. ARBITRATION IS THE EXCLUSIVE MECHANISM FOR RESOLVING DISPUTES UNDER THIS AGREEMENT, AND CERTAIN REMEDIES THAT WOULD BE AVAILABLE IN COURT MAY BE LIMITED OR UNAVAILABLE IN ARBITRATION.
- Any claim, dispute, or controversy, whether arising in contract, tort, statute, or otherwise, and whether pre-existing, current, or future, between you and Utah Gun Exchange, LLC (collectively including its officers, affiliates, agents, and representatives), that in any way relates to these Terms of Use or your use of the Site shall be resolved solely and definitively by binding arbitration.
- Arbitration shall be administered by the American Arbitration Association (“AAA”) in accordance with its then-current rules (the “AAA Rules”), subject to the modifications set forth in this section. The AAA Rules can be accessed online. This arbitration provision is governed by the Federal Arbitration Act and shall be interpreted and enforced accordingly.
- The arbitration will be conducted before a single arbitrator in Utah, unless the parties mutually agree to another location. If the parties cannot agree on an arbitrator, one will be appointed in accordance with the AAA Rules. The arbitrator shall have exclusive authority to determine the arbitrability of any dispute, including any challenges related to the validity or enforceability of this arbitration clause or the Agreement as a whole.
- Subject to the limitations stated elsewhere in this Agreement, including the disclaimers and liability caps, the arbitrator may award any relief that a court of law could provide under applicable law or equity. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court with jurisdiction.
- Unless otherwise required by law, the parties shall share equally in all costs of arbitration, including administrative fees and arbitrator compensation. Each party shall be responsible for its own legal fees and related expenses.

- By using this site you understand and agree with the following:
- I understand and agree it is my responsibility to know and obey all applicable laws.
- I understand that I am responsible for my own safety.
- I understand that Utah Gun Exchange is NOT involved in transactions between parties and DOESN’T certify, investigate, or in any way guarantee the legal capacity of any party to transact.
- I understand that it is my responsibility to protect myself from scams.
- I understand it may be extremely risky to send money to anyone in advance of being certain about their identity and credibility as well as the condition and existence of the item I want.
- I understand that while private firearm sales and transfers may be legal with other residents of my state that are not a restricted person, I may choose to use a firearms dealer with a Federal Firearms License (FFL) to complete transactions involving firearms and other items specified by the ATF.
- I will abide by my local and state laws regarding what is legally acceptable for transactions involving firearms and other items specified by the ATF.
- A Bill of Sale is recommended for all transactions and is available for printout from the UGE website.
- A list of select FFLs is also available from UGE.
- If I am at all unsure about firearm advertising, sales or transfers, I will contact the Bureau of Alcohol, Tobacco, Firearms, and Explosive at 1-800-ATF-GUNS and/or visit the ATF website at http://www.atf.gov.
- I understand and agree that Utah Gun Exchange may remove my listings from the site without notice if they are found to be in violation of the terms or listing policies.
- I agree to abide by the account creation, spam and listing policies found on UtahGunExchange.Com.
- I take responsibility for my actions whilst using UtahGunExchange.com. I also take responsibility for any and all of my actions related to, or resulting from, my use of UtahGunExchange.com.
- Further, I am solely responsible for any and all consequences of my actions.
- I indemnify and hold harmless Utah Gun Exchange and all of its owners, directors, officers, employees, and agents for any and all loss, harm, damage, costs, liability, and expense caused to them, whether intentionally or unintentionally, by my use of UtahGunExchange.com, including but not limited to direct or indirect results of violations of any and all applicable laws.
- Utah Gun Exchange may make changes to the terms at any time without notifying me.
- As a user, I am solely responsible for reading the most current version of the terms and conditions found on the site in multiple places.
- I take responsibility for my actions whilst using UtahGunExchange.com. I also take responsibility for any and all of my actions related to, or resulting from, my use of UtahGunExchange.com.
- Further, I am solely responsible for any and all consequences of such actions.
- Collecting data from UtahGunExchange.com and re-publishing it without express written permission from UtahGunExchange.com is strictly prohibited.
- By using this site, you are expressing consent to this Agreement.
- You are not authorized to use this Site or the content found on it, if you do not agree to this Agreement.

- Utah Gun Exchange (UGE) Terms of Service for Individual and Business ********** Postings
- Paid Listings are for those engaged in business-related activities. Individual listings are mostly free listings and are for non-business and non-service ads only.
- Please use the Business listing type for any ad promoting a service or business.
- Both Business and Individual listing ads can be bumped to the top of their respective category at any time using the Bump Ad feature.
- Limit one (1) Item per ad, one (1) ad per item.
- Spamming, tag spamming, PSAs, profanity and disparaging ads are not allowed.
- Repeated short-term posting of ********** ads before the natural expiration date is not allowed, regardless of subject or item advertised.
- Each listing must include a valid phone number belonging to the advertiser.
- Phone numbers, phone number ciphers, web address, web address ciphers, email address, email address ciphers are not allowed in ad titles, descriptions, pictures or display name.
- The thumbnail & pictures should be relevant to the item being sold.
- Advertisement of the following items is not allowed without express written permission from official UGE management and an upgraded advertisement package: Websites, web addresses, URLs, giveaways, raffles, auctions, events, job postings, help wanted ads, social media pages, subjective price statements as absolute, low price guarantee, or lowest price(s) guarantee(d).
- High volume posters may purchase Coupon Codes at a discounted rate by contacting us at [email protected].
- Standard Ammo ads are for individuals selling less than 174 rounds or 4 boxes of ammo of the same caliber.
- Limit 1 caliber per ad.
- Bulk Ammo ads are for any ads selling more than 174 rounds or 4 boxes of ammo of the same caliber.
- Limit 1 caliber per ad.
- Please contact us at [email protected]. if you want to request permission to do one of these things or upgrade your advertisement agreement.
- All ads are subject to approval. Terms may be changed at any time by official UGE Management to better service the community.
- Ads violating terms or abusing the community by misrepresentation or any other means are not allowed.
- Ads violating terms will not be refunded.
- Refunds of any kind are at the sole discretion of UGE.
- It is your responsibility to know and obey all laws.
- 2022R-17F was amended by the ATF on April 19, 2024, specifically as it relates to who qualifies as “engaged in the business” as a Dealer in Firearms (the “Amendment”).
- The Amendment will be effective 30 days after its publication on April 19, 2024, unless otherwise ordered by a court.
- Multiple states have filed lawsuits challenging the Amendment. You can learn about the Amendment and the various challenges to the Amendment by calling 1-800-ATF-GUNS and/or visit the ATF website at https://www.atf.gov.

- UGE cannot provide any legal advice regarding the applicability of the Amendment or any other legal question.
- It is your responsibility to know the law and ensure that your conduct complies with all applicable laws, including the Amendment.
- UGE is not responsible for independently verifying any information provided by posters, including their identity and authority to transact business as advertised.
- UGE’s failure to enforce these provisions, or delay in doing so, by conduct or otherwise, may not constitute a waiver of any rights of UGE with respect to future actions UGE may take.
- Under no circumstances may UGE be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, revenue, or business opportunities, arising out of or in connection with your use of this website, regardless of whether such damages were foreseeable and whether UGE has been advised of the possibility of such damages.
- All content present on this website is the exclusive property of UGE.
- Unauthorized acquisition, use, or distribution of this content without explicit written permission from an authorized UGE representative is strictly prohibited.
- Legal action may be pursued against individuals or entities found to be in violation of this provision.
- Impersonation and deliberate misrepresentation are not allowed and may result in legal action being pursued against individuals or entities found to be in violation of this provision.
- UGE reserves the right to manage all user accounts according to its own discernment in order to deal with abuse and/or better run the site.
