Utah Gun Exchange Privacy Policy

1. Introduction & Scope

Utah Gun Exchange places a high priority on user privacy. Our privacy policy, effective as of December 21, 2012, and as amended from time to time (the “Policy”), details the nature of information we may collect from visitors and how we ensure confidentiality and security. This Policy was last updated on February 21, 2024. By using this site, you are expressing consent to this Policy. You are not authorized to use this Site or the content found on it, if you do not agree to this Policy.

This Policy describes our current practices for collecting, managing, distributing, and safeguarding personal information that you choose to provide on our website, utahgunexchange.com (the “Site”). We retain personal and other information as long as necessary, in our sole discretion, to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type and use of the data. Please note that this Policy is not applicable to information collected or provided to us outside of the Site. We strongly suggest that you read this Policy carefully before accessing the Site.

2. User Consent; Violations

By using the Site, you are deemed to have accepted the terms and conditions outlined in this Policy. You are not authorized to use this Site or the content found on this Site, if you do not agree to this Policy. Collecting data from the Site and re-publishing it without express written permission from Utah Gun Exchange is strictly prohibited. Persons violating this Policy may be held liable for civil damages (money) and/or subject to criminal charges. Each separate violation may be prosecuted individually. Copyright infringement and other data use violations described in this Policy are subject to damages of no less than $750 for each instance. I acknowledge that violating this Policy can result in a permanent ban from the Site, and could constitute a violation of the U.S. National Do Not Call (DNC) Registry regulations and/or the federal CAN-SPAM Act.

I agree to utilize only one account on the Site, and to solely use the contact methods provided by Utah Gun Exchange and/or the Site to sincerely inquire about items I genuinely intend to buy, sell, or trade.

We may update this Policy at any time. Changes become effective once posted on the Site. We encourage you to review this Policy during each visit so you are aware of the latest terms. By continuing to use the Site, you indicate your acceptance of the revised Policy.

3. Information We Collect

You can choose whether to provide Personally Identifiable Information (your “PII”). If you decline, we may be unable to register you or provide services to you. PII may include but not be limited to your user ID and password for the Site, your name, company name, email address, phone number, contact details, login credentials, payment information, billing address, shipping address, preference settings, IP address, session data and device identifiers such as your MAC address or serial number.

This data is used for technical support, security, customer account management, research, and marketing analysis. 

We may share some of the information you provide or that we collect with companies we acquire, companies that acquire us, or merger/partner organizations. We may also disclose personal information to contracted service providers for order processing, account support, email delivery, and related functions. Information may be shared with law enforcement when required to comply with legal obligations such as a subpoena, copyright infringement, to enforce our policies, or protect our users and the public.

4. How We Use and Share Your Information

If you provide PII to us, whether directly or through a reseller or another business partner, we will not sell or rent your information to a third party without your permission. However, unless you opt out (see below), we may use your contact information to provide you with information we believe is important for you to know or may find useful, such as updates about our services and products, as well as changes to the Site’s Terms of Use. We will take reasonable measures in accordance with industry standards to protect your information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. We will not use or disclose your information except:

  1. as needed to fulfill the services or products you have requested, such as by sharing your information with a delivery service to ensure the products you ordered are delivered;
  2. in other ways outlined in this privacy policy or to which you have given your consent;
  3. in combination with other information in a manner that prevents your identity from being reasonably determined (for example, through statistical compilations);
  4. as mandated by law, such as in response to a subpoena or search warrant;
  5. to external auditors who have committed to maintaining the confidentiality of the information;
  6. to a successor organization in the event of a merger, acquisition, bankruptcy, or the sale or transfer of all or part of Utah Gun Exchange’s assets. The successor organization’s use and disclosure of your PII will still be governed by this privacy policy unless (i) a court rules otherwise, such as in the case of a bankruptcy court; or (ii) the successor organization notifies you that your PII will be governed by its own privacy policy, providing you with an opportunity to opt out (which may affect your ability to continue using this Site. Should you submit PII after such a transfer, that information may fall under the successor entity’s privacy policy;
  7. as needed to uphold and enforce the Site’s Terms of Use; and
  8. as needed to safeguard the rights, safety, or property of Utah Gun Exchange, its users, or others. This may involve, for example, sharing information with other organizations to prevent fraud and reduce risk.

5. Communications You May Receive

Email Messages from Us: The Site sends four types of email communications: (1) notifications about activities, such as purchases and submitted contact forms, (2) Search Notifications, (3) communications related to customer service, and (4) promotional emails, which may include newsletters, subscription-based updates, follow-up messages regarding your activities on the Site, or marketing information about our products and services, as well as those of our affiliates or trusted partners.

Mobile Communications, Messaging and Cellphone Number Account Verification: To open and maintain an account, the Site requires all users to provide a mobile phone number linked to them and capable of receiving SMS messages to help reduce fraud. The Site uses four types of mobile communications: (1) verification of the cellphone number and related information associated with your cellphone account, (2) communications related to customer service, (3) notices of messages waiting for you in the internal message center of your account on the Site, and (4) promotional messages from Utah Gun Exchange concerning it and its trusted affiliates and partners. These messages are sent infrequently.

6. Your Choices and Controls

  1. Transactional Messages: Notifications regarding your activity on the Site are generated when you register as a user, purchase items, or list items for sale. These notifications may include but not be limited to confirmations of item listings, results for Search Alerts you have created, notifications when items are sold, billing messages, and other relevant alerts. You cannot unsubscribe or decline participation in these transactional notifications; however, if you do not list any items, purchase anything from UGE and your account balance is zero, you will not receive such notifications. As a registered Buyer or Seller, you may also receive important notices about significant changes to the Site’s policies or operations. These notices are infrequent and can only be avoided by closing your account with us.
  2. Search Alerts are created at your request to notify you when items that meet specific search criteria are listed on the Site. Each notification message includes instructions for removing yourself from the alerts.
  3. Promotional E-mail Messages: Utah Gun Exchange may send various promotional e-mail messages on our behalf and on behalf of our third-party advertisers. You may unsubscribe from receiving such communications at any time by emailing us at [email protected] from the e-mail account associated with your UGE account along with the subject line “E-mail Opt-Out,” or by clicking the “Unsubscribe” link found in the footer of all promotional emails. Keep in mind that if you share your email address with one of our third-party advertisers in response to their email, you will need to opt out of future marketing emails directly with that advertiser. We are not responsible for the data privacy practices of any third party with whom you choose to engage. We recommend reviewing the privacy policy of any such party before sharing your personal information with them.
  4. Promotional SMS Messages from Utah Gun Exchange regarding it and/or Its Trusted Affiliates and Partners: the Site may send SMS messages to users that include promotional material from the Site and its trusted affiliates and partners. Users have the option to opt out of these messages at any time by emailing [email protected] from the e-mail account associated with your UGE account along with the subject line “SMS Opt-Out.” By opting out, you acknowledge and agree to receive a final text message confirming your opt-out status. It is your responsibility to inform us if you no longer wish to receive text messages. If you do not opt out promptly or fail to follow the provided instructions, you waive any rights to claims for unauthorized or unwanted calls or text messages. Please allow up to thirty (30) days for us to process any opt-out requests. Note that if you opt out of text messages, the company maintains the authority to make non-automated calls to you.

7. Cookies and Tracking

Utah Gun Exchange utilizes ‘cookies’ to store personal data on your computer. We may also connect information saved in cookies on your computer with personal data about specific individuals stored on our servers. If you configure your web browser (such as Internet Explorer, Firefox, Chrome, Safari or Brave) to block cookies, access to some or all features of our website(s) may be restricted.

8. Third-Party Services and Analytics

Google Analytics is a web analysis service offered by Google that uses cookies to monitor web traffic on the Site. We utilize Google Analytics to collect, track, and analyze data regarding the usage of the Site. 

Please note that the Site may not respond to Do Not Track signals from your browser.

Please be aware that this Policy is not applicable to the collection and use of information by companies that Utah Gun Exchange does not control, nor to individuals who are not employed by or managed by Utah Gun Exchange. If you visit a website that we reference or link to, please review that site’s privacy policy before sharing any information with it.

 Please do not share any ideas, suggestions, proposals, or comments that you consider confidential or wish to be treated as such as we may also keep your questions and feedback to enhance the Site. 

We may keep your data on servers operated by third-party hosting vendors that we have contracted with. If you no longer wish for us to use or retain the PII you provided, you can contact us at [email protected] and request the deletion of your PII from our records. 

9. Data Security and Protection

To help protect your privacy, please make sure to:

  1. ensure that you log out the Utah Gun Exchange website when you are done;
  2. avoid disclosing your login credentials with anyone;
  3. take common precautions to protect against ‘malware’ (such as viruses, Trojan horses, and bots), for example, by installing and regularly updating reliable anti-virus software.

10. International Users

Utah Gun Exchange operates in the United States. The Site is hosted in the U.S. and is designed for users within the country. If you are accessing the Site from the European Union, Asia, or any other region with laws regarding personal data collection, usage, and disclosure that differ from those in the U.S., your ongoing use of the Site-governed by U.S. law and these terms-constitutes your consent to the transfer of your PII and other data to the United States.

11. Changes to This Policy

We reserve the right to revise this privacy policy as needed to comply with legal requirements or to reflect changes in our business practices. If you have given us your email address, we will make reasonable efforts to inform you via email of any significant changes regarding the use of your PII.
